These Terms of Service govern your access to and use of the90s.ca, including purchases made through the website.

The website is owned and operated by Ever Wright Group Inc., an Ontario corporation.

By visiting the website, creating an account, placing an order or otherwise using our services, you agree to these Terms of Service.

1. Eligibility

You must be at least the age of majority in your province, state or territory and legally capable of entering into a binding agreement.

A parent or legal guardian must make purchases intended for minors.

2. Our Products

the90s.ca offers mystery boxes and may also offer retro merchandise, collectibles, toys, games, cards, electronics, media, clothing, accessories, novelty products and related items.

Possible mystery-box contents may include:

• Video games, consoles, handheld systems and gaming accessories
• Magic: The Gathering cards and other trading cards
• Sports cards
• Comic books
• POGs and slammers
• TMNT figures and other retro toys
• Action figures, troll dolls and Tamagotchis
• Walkmans, Discmans, headphones and boomboxes
• Music cassette tapes
• DVDs and VHS tapes
• Band, movie and pop-culture shirts or merchandise
• Slap bracelets, hacky sacks and novelty accessories
• Candy necklaces, Ring Pops and other packaged candy
• Rare, unusual or collectible merchandise
• Select products from the 1980s

This list is illustrative and not exhaustive.

3. Mystery-Box Nature of the Products

Mystery boxes contain undisclosed and randomly or curator-selected merchandise.

Unless a product page expressly guarantees a particular item:

• No specific product, brand, franchise, category or quantity is guaranteed
• Product photographs are illustrative examples only
• Products shown in advertisements may not appear in your box
• Boxes within the same price tier may contain different items
• The mix of items may vary significantly
• Receiving an item in one customer’s box does not guarantee its inclusion in another
• Customer preferences or requests may be considered but are not guaranteed
• Duplicate items may occasionally be included

By purchasing a mystery box, you acknowledge and accept the surprise nature of the product.

4. Product Condition

Mystery boxes may contain products that are:

• Brand new
• Factory sealed
• Open-box
• Used
• Vintage
• Previously owned
• Incomplete
• Without original packaging
• Subject to ordinary cosmetic wear

Condition varies according to the product’s age, availability and collectible nature.

Vintage merchandise may show fading, scratches, scuffs, creases, marks, worn packaging, discoloration, missing instructions or other age-related wear.

These ordinary variations do not, by themselves, make a mystery box defective or eligible for a return.

5. Electronics and Media

Retro electronics, games, tapes, discs and other media may be several decades old.

Unless expressly described as tested and fully functional:

• Functionality is not guaranteed
• Batteries may not be included
• Original accessories, cables, manuals or packaging may be missing
• Battery compartments may show ordinary age-related wear
• Devices may require cleaning, repair, replacement parts or region-compatible equipment
• Magnetic and optical media may have playback imperfections
• Games and media may require hardware that is not included
• Online services originally associated with older products may no longer operate

Customers should inspect vintage electronics before use. Do not use a product that appears damaged, corroded, unsafe or unsuitable for modern electrical systems.

6. Collectibles and Estimated Value

Any statement concerning retail value, market value, comparative value or the value of a mystery box represents a good-faith estimate based on factors such as:

• Recent market observations
• Comparable listings
• Collectible demand
• Original or replacement retail pricing
• Age, rarity and condition
• Our reasonable internal valuation

Collectible values can fluctuate and may differ between marketplaces, regions and buyers.

We do not guarantee:

• A particular resale value
• That every item can be resold
• A profit from resale
• A specific third-party appraisal
• A specific value for each individual item

Any representation that a box contains greater overall value than its purchase price refers to our reasonable aggregate valuation at the time the box is assembled and is not a promise of cash value or resale proceeds.

7. Food and Candy

Any food or candy included will be commercially packaged when shipped.

Customers are responsible for reviewing ingredient, allergen, dietary and best-before information before consumption. Do not consume an item if its packaging is open, damaged, missing required information or otherwise appears unsafe.

We cannot guarantee that products are free from allergens or cross-contamination. Mystery boxes are not suitable for customers who require guaranteed exclusion of particular food ingredients unless expressly arranged and confirmed in writing.

Candy and small novelty products may present choking hazards and should be kept away from young children.

8. Product Images and Trademarks

Product photographs, brand names and franchise references may be used to illustrate the types of authentic or compatible merchandise that could be included.

Unless expressly stated, Ever Wright Group Inc. and the90s.ca are not affiliated with, endorsed by or sponsored by the owners of third-party brands, entertainment franchises, sports leagues, artists, manufacturers or intellectual property appearing in product listings.

All third-party trademarks remain the property of their respective owners.

9. Pricing and Taxes

Prices are displayed in the currency identified on the website.

Applicable taxes will be calculated at checkout. We aim to display mandatory non-government charges clearly before purchase. We will not intentionally add undisclosed mandatory service charges after advertising a product price. Canadian competition guidance treats unattainable advertised pricing caused by mandatory non-government fees as misleading drip pricing.

We may correct pricing, description or inventory errors before an order is fulfilled. If an order is cancelled because of our error, the amount paid for the cancelled item will be refunded.

10. Payment

You represent that:

• You are authorized to use the payment method provided
• All billing information is accurate
• Charges associated with your order are authorized
• You will not initiate an improper or fraudulent chargeback

Orders may be held, rejected or cancelled if fraud, unauthorized activity or a payment issue is suspected.

11. Order Acceptance

An order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance.

We may reject or cancel an order before shipment because of:

• Suspected fraud
• Pricing or inventory errors
• Payment failure
• Shipping restrictions
• Product unavailability
• Quantity limitations
• Resale or misuse concerns
• An inability to fulfill the order safely or legally

If we cancel a paid order before shipment, we will return the applicable amount to the original payment method.

12. Shipping

We currently ship eligible orders to addresses in Canada and the United States.

Mystery-box orders include free standard shipping, unless a product page or checkout page expressly states otherwise.

Free shipping does not necessarily include:

• Expedited shipping
• Remote-area surcharges disclosed before purchase
• Import duties
• Customs charges
• Brokerage fees
• Local taxes imposed by the destination jurisdiction
• Redelivery or address-correction expenses caused by incorrect customer information

Customers are responsible for providing a complete and accurate shipping address.

Delivery dates are estimates and are not guaranteed. Delays may occur because of weather, customs, carrier interruptions, peak periods or circumstances beyond our reasonable control.

13. Customs and Cross-Border Orders

United States orders may be inspected by customs authorities.

Customers are responsible for complying with destination-country laws and for paying any import duties, taxes, customs fees or brokerage charges not expressly included at checkout.

We are not responsible for delays, seizures or additional charges caused by customs authorities, prohibited imports or inaccurate customer information.

14. Lost, Stolen or Damaged Shipments

Customers must contact us promptly at info@everwrightgroup.com regarding a shipment that appears lost or arrives materially damaged.

We may request:

• The order number
• Photographs of the shipping box
• Photographs of the shipping label
• Photographs or video of damaged contents
• Preservation of the packaging
• Confirmation of the delivery address
• Cooperation with a carrier investigation

We are not responsible for theft occurring after confirmed delivery, but we may assist the customer with an available carrier claim.

Any replacement, credit or other remedy will be determined according to the circumstances, available carrier coverage and applicable law.

15. Final Sale

All mystery-box purchases are final sale.

Because each mystery box is assembled as a surprise assortment, we do not accept returns or exchanges because:

• The customer dislikes the contents
• The customer already owns an item
• The customer expected a different item
• A preferred category was not included
• Individual items have varying conditions
• The customer disagrees with potential resale value
• Product photographs showed different example items
• The customer changed their mind

Nothing in these Terms excludes a right or remedy that cannot legally be excluded under applicable consumer-protection law.

16. Cancellations

Orders may begin processing shortly after they are placed.

Cancellation requests are not guaranteed. Once an order has been assembled, processed or shipped, it cannot be cancelled.

17. Promotions and Discount Codes

Promotions may be subject to additional terms, expiry dates, eligibility requirements and product exclusions.

Discount codes:

• Have no cash value
• Cannot be retroactively applied
• May not be combined unless expressly permitted
• May be cancelled if obtained or used improperly

18. Acceptable Use

You may not:

• Use the website for unlawful or fraudulent purposes
• Attempt unauthorized access to accounts or systems
• Interfere with website security or operation
• Scrape or harvest information without permission
• Upload malware or harmful code
• Impersonate another person
• Submit false reviews or fraudulent claims
• Abuse discounts, promotions, refunds or chargeback systems
• Copy or commercially exploit website content without authorization

19. Intellectual Property

The website, the90s.ca branding, original graphics, photographs, descriptions, designs, text and other original content are owned by or licensed to Ever Wright Group Inc.

You may not reproduce, distribute, modify, publish, sell or commercially exploit this content without prior written permission.

20. Reviews and User Content

If you submit a review, photograph, video, testimonial or other content, you confirm that:

• You own or control the content
• It is truthful and lawful
• It does not infringe another person’s rights
• It does not contain malicious code or confidential information

You grant Ever Wright Group Inc. a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for business and promotional purposes, subject to applicable law and any specific agreement with you.

21. Disclaimer of Warranties

To the fullest extent permitted by law, the website and products are provided on an “as available” and “as is” basis, subject to any express description and any rights that cannot legally be excluded.

We do not warrant that:

• The website will always be uninterrupted or error-free
• Every vintage product will function as originally manufactured
• Products will increase in value
• A mystery box will contain any specific item
• Colours shown on screens will be exact
• Third-party services will remain available

22. Limitation of Liability

To the fullest extent permitted by law, Ever Wright Group Inc., the90s.ca and their directors, officers, employees, contractors and agents will not be liable for indirect, incidental, special, punitive or consequential losses arising from use of the website or products.

Where liability cannot be excluded, our aggregate liability relating to a product or order will not exceed the amount paid for the affected product, except where a different remedy is required by law.

Nothing in these Terms limits liability that cannot legally be limited.

23. Indemnification

To the extent permitted by law, you agree to indemnify Ever Wright Group Inc. against losses, claims and expenses resulting from your unlawful use of the website, violation of these Terms or infringement of another person’s rights.

24. Governing Law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Any dispute will be submitted to the courts located in Ontario unless applicable consumer law requires otherwise.

25. Severability

If a provision is found invalid or unenforceable, the remaining provisions will continue in effect.

26. No Waiver

A failure to enforce a provision does not waive our right to enforce it later.

27. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted with a revised effective date.

The Terms in effect when an order is placed will generally govern that order.
